If the political leaders of the US weren't exempt from the laws their subjects have to live under, Bush and Cheney would be in jail. Or dead.
War crimes and crimes against humanity are capital offences, and both Germans and Japanese died for what these folks did, including waterboarding.
Morality isn't relative. But the US exempts it's leaders.
