The hazard of treating health problems as criminal acts

That's what we have here. These would be cousins of the same health fascists who gave us Prohibition and continue to give us the *cough* War On Drugs.

As far as motorcycles are concerned, the legislature just repealed the helmet law here, and it has helped us identify idiots with much greater ease. Even a child can spot them, and I have heard children remark on the lack of safety equipment. "Why isn't his mommy making him wear his helmet? Doesn't she love him?", etc. We expect the number of organs available for transplant to rise soon. The answer to the wind-in-my-hair crowd is a huge insurance premium to cover their huge increased risk.

The smoking issue is also deceptively simple: rather than ban smoking, the non-smokers can organize to provide lists of establishments that don't permit smoking and patronize only them. If smokers are truly in the minority, it wouldn't take long for businesses to reduce their tolerance of smoking on their premises. "Hmmm. Let's see... 80% of the public won't come to my place, and the 20% who will keep leaving cigarette burns on the furniture... Let's go smoke-free next month!"

The trouble is, the non-smokers would have to organize and act. It's a lot easier to let someone pass a law.
