The water is subsurface.
Going by the GRS results on Mars Odyssey there is appreciable water/ice within centimeters of the surface, perhaps 10% by mass.
The temperatures will be higher than the current temperatures during mid-Summer and might allow above freezing temperatures to permeate centimeters subsurface.
