You forgot that in the 2nd gulf war Sadam issued orders to his commanders along the lines of: "USE 'EM IF YOU GOT 'EM"

They didn't have them... and that was a very good thing.

Would those 1038 deaths be justified if Sadam did use WMD?

A honest "YES" or "NO" answer will do.
