It is just that I haven't and won't put in the time to find out what I need to, to have an opinion on this case. I've never been there. Don't know how big an area this covers or how important is the ecosystem that it attempts to protect. How many property-holders are affected. Or if anyone at all, lives in this area now?
In general terms (as displayed below) I do not believe that you can do anything you damn well please with your land. And believe it or not, the law is on my side.
Another example I could have given, but did not was water rights. If a stream goes through your property, and there are established down-stream users, you have no right to do something that will decrease the amount of water these users receive.
And my question to Larry remains unanswered: If you are so certain that the law is on your side, why are you worried? Any affected land-holder can file a claim.

Sorry. Did it look like I was shrugging?
