If that were literally true, you'd be in jail, too.
Assuming that any of this actually turns out to be true:
Does anyone remember the terrorist who declared us "stupid" for our sentimentality? The one that was let past a checkpoint because he needed to get someone to a hospital?
These are choices.
We can choose to treat these high-level prisoners exactly as you would treat someone who got hauled in for drunken driving. That may be the moral high ground.
But it's going to cost American lives. Overseas certainly, and possibly in our own country. Maybe this is a valid tradeoff to maintain our way of life and staying on the high ground. You could make a real case for that.
But it's just like the choice our military made to use on-the-ground, door-to-door, up close battle tactics in Iraq instead of annihilating our enemies with attacks from ten thousand feet. It's going to cost American lives.
So, just keep that in mind while you keep your morbid death count.
