Trickle-down politics
Wow. What hit me as significant about this is the idea that Congress can decide what parts of the Constitution the Judiciary has a right to consider, and fence off the parts where the judges might disagree with a Republican Congress. In what parallel universe is it right for one branch of government to trim away bits of the independence and power of another branch of government?
Oh, right, almost forgot Bush's 750-odd "signing statements" in which he declines to be bound by laws Congress passes. It's a primate thing, I guess: Bush hits Congress, Congress hits the Judiciary. I'm not sure who the Judiciary can hit, but I have a nasty suspicion it's us.
