If they are POWs, we can't hang them without trial. If they are considered terrorists, we must only show that they are illegal combatants (concealed weapons, etc) at a court martial to hang them. But, and this is nice, if the are POWs, we never need to bother to try them. We can keep them until a peace treaty is signed with Al Qaeda (or until the Sun burns out, whichever comes first). Also, I don't know if illegal combatants are to be shot or hanged. It is a minor technical point.
