If you talk to Rutan, Musk, or anyone else in the private space business, they'll tell you that the regulatory issues are often more difficult than the technical ones. Many times the regulations, like the one mentioned in the article, are arbitrary, inconsistent, and unreasonable. Some, like Rutan, will tell you this in public. Others won't.
