John Walker needs to be put away in a plea arrangement
If he is tried as a civilian criminal, a good lawyer (and he will have basicaly the dnc leadership on this) would make the case that anything he said to an official of the US govt. prior to his being provided counsel is inadmissable.
It seems from the reports that Walker is cooperating fully.
If this is so, then he should be manivered into pleading out an agreemnt to be either sentanced to prison in the USA or turned over to the Afghan government and treated as any other of the invading Al Qaeda.
