No, that won't be established until they're tried. What has been established are several damning bits of evidence like the rifle that matches the ballistics evidence, fingerprint evidence from a murder in Alabama, and quite a few other pieces of evidence that's hard to explain away.

There are a number of - shall I say- irregularities emerging in the pertinent details of this case, so I think we need to wait and see.

But of course, in the land of whack job conspiracy theories, no amount of actual evidence is conclusive! There are always "irregularities" if one is gullible enough to believe the conspiracy theories.

By contrast, in the case of F. 587, I don't think there's any question, at least in my mind, that the plane the eyewitnesses have described is the one which actually crashed.

There's no doubt they saw the plane crash. There's a lot of doubt they understood what they were seeing. Eyewitness accounts of plane crashes are notoriously inaccurate when compared to the crash scence evidence.
