Historical examples abound.
In the Ardennes in Dec/1944, captured
US GI's were mowed bown by Waffen SS
machine-guns, even though the US soldiers were disarmed and POWS.
Correct me if I'm wrong, but I don't
think the commanding SS colonel was ever convicted during an American court-martial for those crimes after the war.
Neither were the North Korean prison
guards apprehended & tried for beating, torturing and mistreating
US POWS.
The same applies to the brutalizers,
of the captured US POWS in Vietnam.
