I would suggest that the blog you refer to has a pretty strong agenda, in their own words, to make that conclusion.

I don't think the story is bogus at all.
I think that the rebound from many years of ACLU suppression of free expression is just beginning. The ACLU has gone way past too far.
Calling it a lie because people the blogger doesn't appprove are supporting the suit does not make it so.
