Well, "when I was a kid"...

...people did all sorts of things that I do not feel the slightest bit accountable for. I promise not to hold you responsible for Tailgunner Joe's deeds, if you don't hold me responsible for anything other's did when I was a kid (or before I was born).

That aside, congress has today - and cheerfully executes - all of the checks on the judiciary that they are intended to have. To add more is a power-grab by the legislative branch (and should be found to be unconstitutional by the supreme court).

As far as judicial's role in the CA referendum process, it is natural and normal and was always the case and will always be the case. Legislating authorities - people by referendum or elected or appointed legislating bodies - are all able to pass laws without regard to their legality nor their constitutionality. It is the court's domain to straighten out the mess. How could you not know that?
