While they aren't being charged criminally, they're still going to get reamed by the "Friendly Aviation Administration", as well they should. Both of them will undoubtedly be grounded for quite some time.
Groups like the Aircraft Owners and Pilots Association (AOPA, I'm a member) have been working for over 3 years to get Reagan International Airport reopened to general aviation* airplanes since we were banned following 9/11. Stupid incidents like the one yesterday sure don't help. Here's their report.
Note to Mary Anne, they may not have turned off their radio, just had it on the wrong frequency. Most general aviation comm radios have 720 different channels. Given they were clueless to their position, they might well have been tuned to the wrong frequency, too. Also, the radios on most military airplanes operate in a different frequency band than general aviation radios.
*General aviation is defined as all aircraft other than the airlines and the military. There are several hundred thousand of them in the US, ranging from ultralights through corporate jets.
