Current Events » in reply to Judicial activism in Kansas

Perspective

Many state constitutions refer to education as the state's "paramount" responsibility. The term "paramount" actually has signiificant legal meaning, with a history of case law across the country backing up the meaning of the term. In otherwords, the State's Constitution guarantees adequate funding for public education. In this regard, the Kansas Supreme Court was merely applying facts to the law in arriving at their decision. That is not "judicial activism." Its called upholding the Kansas State Constitution.
