I seriously doubt that civilian news organizations are involved in the decision making process in regard to exercising war time policies and practices...

Of course, I suppose someone could make the argument that we are not in a "time of war".

I'd love to see the Supreme Court rule on this and other related "War Power's" issues.

If they rule to broadly (too much for privacy) or two narrowly (too much for the intellegence services right to collect private info) then our Democracy could actually be undermined by its very existence.

One thing is for certain: The New York Times is really not that important a player.
