Before, they were held as illegal combattants, which means that they could be tried, and potentially freed. Then there was a big stink by the Left to give them POW rights. It worked. Now they are POWs. POWs have no right to trial. They are to be held until the cessation of hostilities. When the USA & Al Qaeda sign a peace treaty, and only then, do they need to be released. When that happens, elephants will fly with their ears and rattlesnakes will tapdance.

In other words, since they have been reclassified as POWs, they can legally be held forever without trial.
