Uniformed troops captured on the battlefield are held until the war is over. Nobody gets a trial, nobody gets an attorney, and nobody gets to sue to be released early. They are to be treated according to the Geneva Conventions, and that's it. That's people who are fighting according to the Geneva Conventions, BTW.

Attempting to shoehorn terrorists captured during a war into the same category as an American citizen hauled in for twisting the heads off parking meters is lame.

But by all means, keep it going. Start distributing Miranda cards on the battlefield, and demand that those who have not been properly charged be released immediately.
