Killing him will clearly establish the rule of the Iraqi government and courts.

It says to all Iraqi's...This is the Sovereign Government of Iraq...Love it or hate it, we own you...

the US Government does the same at tax time...But abstract things like paying taxes to a government you don't always agree with mean nothing until the State has clearly established that YOU HAVE NO CHOICE...COMPLY OR DIE.

After Iraq has clearly established its "legitimacy" and "authority" by making examples of Sadam and a few other thugs, then the Iraqi people will begin to respect it's authority...Even though they may disagree with that authority...

Think of it as a Boot Camp of sorts... They gotta break em down, and then build them up.

In a few years, they will hopefully have the luxury of being a capital punishment free nation.
