Context

I would think that Craig could argue he is free to tap his toes. Words are very nearly meaningless except in some context.

He is also free to move his foot over and tap another guy's foot while seated in a public restroom.

He's also free to wave his hand under the separator.

It seems to me it's a bit like his being able to say the words "blow", "me", and "now". And if he's all alone in the Mojave Desert, 30 miles from the nearest ears and lips, it would be meaningless. Or if he's in his motel room with a consenting adult it might be appropriate.

However, to say "blow me now" to another guy in a public restroom, even if the guy is in a mini-skirt and wearing lipstick (non-smear, I presume), it might be construed as soliciting sex which is illegal in that place at that time.

No matter how one says it. He put together a series of "free speech" activities, the cumulative effect of which would, I believe, constitute the solicitation of an illegal act, said solicitation being illegal in that context.
