Is there a simple solution this?
The decision to torture can NOT be a part of the US legal system. It goes against all that this nation stands for and was created for.
Torture CAN deliver information on the ‘ticking bomb’. I don’t care what you hear in the press it can and does deliver. The Nazis were able to control whole nations of people by extracting confessions by torture.
That’s the problem isn’t it. And now for the answer.
Make it *very* clear that we will prosecute anyone who tortures anybody for ANY reason (even the ‘ticking bomb’). Then the individual has to make his own decision.
“If I torture this guy I can probably stop ‘the bomb’ but I know I’ll be put in prison – Is it worth the priceâ€.
