Perhaps the FCC should intervene...
...not to regulate commerce, but to implement realistic technical standards which would prevent the benefits of the technology from being diluted for strictly commercial purposes. TV signal quality may not be of vital national importance, but the crowding of internet bandwidth has serious implications for more critical channels of communication. The electromagnetic spectrum is part of the commons, it belongs to all of us, and the conversion to digital TV was made necessary by the regulatory agencies primarily for the benefit of the industry--the industry should have some responsibility for its rational use.
