Protected speech

<For the record [...], individuals and organizations would not be allowed to express their opinions in advertisements within 30 days of a primary or 60 days of an election. How is that NOT a violation of the First Amendment?

The operative word is advertisement.

If, as public-spirited citizen, you and your friends discover something the public ought to be aware of while making their choice at the polls (which, btw, is nearly oxymoronic: aware voters), the solution is simple: a press conference.

As the current crop of squeaky wheels rushes to defend advertising as 'protected speech' under the First Amendment - which it is - the sound and fury theyre generating disguises the plain fact that advertising is not the sole form of political speech.

It strikes me as extremely curious, yet unfortunately inevitable, that there are those (not among us here, of course!) all too willing to trade someone else's liberties for an increased sense of security, but not an iota of their own for an increasced sense of fairness.
