You are forgetting there were a wide range of sanctions on Iraq. Not only were WMD banned but conventional weapons were supposed to be limited to prevent a repeat of the Kuwait invasion which DID NOT use or need WMD.

But of course if there are no WMD Saddam is to be forgiven for all his other treaty violations and treatment of his own people right?
