I don't have a good answer. Was the draft ever opposed on this point? Odds are, yes. I don't know if it was ever addressed by the Supreme Court. But then, the Supreme Court is far from infallible. At one time, they ruled that "Separate but Equal" eduation was fine, only to reverse it decades later in "Brown V. Board of Education." There was the infamous Dred Scott decision and the one approving the internment of people with Japanese ancestry in WWII, as well as the restrictions on free speech in the McCain-Feingold CPR legislation.
Some 2-3 million teenagers turn 18 each year. Are we going to force all of them into compulsary service? If not, then what criteria will be used to determine who has to give up several years of their lives and who gets a pass? How much will it cost to implement his program? By one estimate, if 500,000 kids were in the program and got $5000 a year towards a college education, that's $2.5 billion per year. Not exactly small change.
Current Events » in reply to Then why wasn't it successfully used against the draft in any war since?
Good question.
