What bloody difference does it make? There is no humane way to die from modern weaponry. Why is napalm so bad when white phosphorus use has already been conceded? The only possible crime that could be at issue here is if this sort of weapon was deliberately used on civilians as an instrument of terror, which our enemies there freely admit to doing. If civilians were killed accidently, but not deliberately, that is an unavoidable consequence of any war. If we use any weapons against civilians as an instrument of policy, or if we cover up and ignore unauthorized use of such to protect rogue elements of our forces, that is worthy of our outrage. That innocent people suffer is simply part of war. There may be many good reasons to be out of Iraq, but this is not one of them.
