Novak's whistling in the dark, and his opinions seem to be based on wishful thinking. Tom threw out a snide comment about waiting until 2008, but I do think that the date is a factor, in this case, November 2006.
Prosecutors shop for a sympathetic jury, and in a case that could result in charges of an impeachable offense, Fitzgerald would have to be nuts to bring his case before a Republican Congress, only to have it swept under the rug by partisan ass-covering. Christ, putting the case before a Republican Congress is like packing the jury in a Mafia trial with Mafia hitmen. Fitzgerald would be guilty of dereliction of duty if he acted now, knowing that.
The fact that Fitzgerald hasn't closed the case and seems to be in a holding pattern is telling. If it were over he'd say so. No news from Fitzgerald is "good" news...insofar as it's good that justice is served, not so good the crimes that require justice.
