The 5 percent was the bill's status prior to DeMint's amendment. Democrats rammed nothing down anyone's throat. A play by play on this blog.
Both Democrats and Republicans have resisted these reforms, and both Democrats and Republicans have been among those demanding them. Generally, it seems to me that the resistance to reform is proportional to how long someone has been in the Senate, although there are exceptions. Term limits wouldn't suck in the Senate.
To their credit, liberal bloggers have been lambasting Reid on this issue too today.
