No different really than sex in a public park, which has been illegal in most places for years with no constitutional issues. And a bathroom stall is anything but "private" if something is going on in there.

As an aside, I noticed something a few days ago at a restaurant when I was using the bathroom. I had my feet spread out quite a bit sitting there. I had a good reason for it--the goddam puddle in front of the john from people who can't seem to hit the broad side of a barn while taking a whiz. I was instinctively trying not to step in it.

It also takes some doing to keep your pants from falling in it. If there's one thing worse than coming back from the bathroom with a wet blotch on your pants, it's having it be from someone else's wet.

Later, I noticed the same situation at a urinal, and that I had to stand with my feet apart not to step in the pee. Good grief, what kind of moron can't hit a urinal?

Not that I think Craig was dealing with the same problem. There were too many other weird things in his behavior besides just that.
