Not to put too fine a point on it, but it has not been established yet that this was actually illegal. We're not quite at the point where the legality of something is determined by the number of politicians screaming "illegal" in speeches. Close, though.
You might have noticed that this is all about immunity from lucrative civil liability suits, not about whether or not the telecoms can be legally prosecuted.
