Personally...
If I own the copyright on something, I should have the right to say "no" to someone using anything I write without regard to the why. Otherwise, you'd clog courts further that are already clogged sorting out crap they have no business sorting out. Someone can quote a bit of anything without regard to permission if e.g. they are reviewing the work or doing something else that is considered a permissible purpose.
