It is setting thieves to watch thieves.
A propsed ameendment to the ocnstitution when it was written would have prohibitted memebrs of one branch from serving in another.
This would mean that legislators could not serve in the military,
it would prevent active military from serving in the legislature, and it would have kept officers of the court (lawyers) from serving in the legislature.
What a wonderful difference this would make.
