Your standard of evidence is extremely weak. Using the exact same standard would have Pakistan and Saudi Arabia classified as Al Qaeda client states. Arresting a middle-level functionary with one leg missing is not exactly a coup de grace. Finding a five year old memo and little else is no smoking gun, in fact, it suggests precisely the opposite.
