The water comes from the ATMOSPHERE not subsurface.
If this water BEGAN subsurface you might be able to argue it stays frozen. But this water is starting at the top of surface not beneath it. Therefore at the beginning it is exposed to the entire temperature cycle from freezing to melting. In particular this water vapor is being deposited and diffusing subsubsurface during the daytime, Summer as well.
