Certainly mistakes are possible. The Iraqi security forces will do their level best to sort them out. However, when you kill the judges, prosecutors, and police and then demand "due process" I must ask, "From whom?". Will the dead police read you your rights and handle you according to law? Will the dead prosecutors prepare a court case against you? Will the dead judges preside at your trial? Will the dead journalists cover your trial to make sure that it is fair?
It reminds me of the guy who murdered his father and mother and then asked for mercy from the court because he was an orphan. Sorry, when you attack the justice system, don't expect it to work for you.
The problem is that the resources required do not exist. Most of the arrested are simply imprisoned until a trial someday, maybe. Those whom the police/army/etc are convinced are guilty are going to get a very rough treatment. Some of them will be innocent. But, on the whole, more innocent lives will be spared this way. When you KNOW that a guy has murdered your friends and relatives, and knows where more of his buddies are, it is difficult to go easy on him. Put yourself in the place of the Iraqi grunts in the field. Ask yourself how YOU would react under the circumstances, after your friends and relatives had been murdered.

- Why the demand for "due process" for terrorists in Iraq is absurd.
- Cuz terrorists don't always have a "I am a Terrorist" tattoed on their foreheads.
- As long as we are willing to pay the price.
- When you catch them in a firefight, what is to figure out?
- Because you dont always catch them in a firefight that's why.
- re: Because you dont always catch them in a firefight that's why.
- And the people caught in a dragnet, or falsely accused by a personal enemy, what do you call them?
- Well, if they weren't so busy killing
