My position on this is that, solely from the legal point of view, there is no logical reason to treat marijuana differently from alcohol. Either both are legal, and regulated, or both are prohibited.
More dangerous drugs raise more complicated problems. Through most of human history, opiates and other drugs were legal, and taken in (relatively) diluted forms. Opium pipes. Chewing coca leaves. The Sumerians cultivated "joy plants" (poppies) in 3400 BC. There were still addictive issues, but apparently not lethal enough to select susceptibility to addiction out of the human race.
Now we get drugs engineered and concentrated to very dangerous and highly-addictive levels. I don't have a pat answer for how to treat this legally. Prohibition creates, by its very nature, black markets and criminal activity. Are we better off treating more victims of addiction, or supporting vast criminal enterprises?
