I agree with your reluctance about making this a Constitutional issue.
But as is often the case in religious/moral questions, failure to do so means the debate is dominated and controlled by special interest groups with an ideological or religious axe to grind. I believe that in this case, Federal and judicial intervention has resulted in law which coincides with the national consensus on the subject.
