Doesn't really matter. One of the concerns of the Founding Fathers was a government which could arrest and/or detain a citizen without a charge. One of the fundamental rights of the US is habeus corpus, they have to show a court a reason to hold a person.
That right is in the constitution.
The countries which can arrest and detain a citizen without a charge are usually called totalitarian.
And it's always done in the name of national security, and they start with the bad guys. In Germany they started with the Jews, and since Jews had been demonized, no one had sympathy. (Not even the US or the Pope.) It was called national security.
It wasn't, of course, but it's always called that.
Just go to court and charge the guy. Hold him without bail. But don't grab citizens, call them "enemy combatants", and hold them forever. Not even the ugly people.
