I'm not at all sure that the Founding Fathers intended the law of the land to be arbitrarily set by what side of the bed five out of nine justices got up on in the morning.

The fact that the same thing can be "constitutional" one day, and "unconstitutional" the next, should make people a bit nervous.

No wonder both Democrats and Republicans sweat bullets over who is going to be on that court.
