And be sure, the hackers that Big Brother employs will have thought of those ways to defeat it, and may or may not be one step ahead.
While I still have yet to go read the patent, The system seems to be very 'network centric', this means its harder to defeat because its very hard to exert any control, in a defensive measure, against the network itself. Your control, unless you are very good, ends at the wall. The only classes of defense that I can see are
1) IP Proxy systems
2) being able to tell when Latency Maps are accumulated and making changes at strategic times.
3) Making your own latency map and 'mimicing' other locations behind the last node in the net.
1 has the honey pot problem, 2 WILL show up on statistical maps of latency-location maps drawn over time where whole areas are profiled. 3 is a good bet, but has some of the vulnerabilities of 2 and requires you to have some heavy resources.
Everything that is not proven to be impossible (in the formal rigorous mathematical sense) is possible, but an infinite sublcass of the possible will take infinite time- provably so. Finding a defense is something i am sure will happen, but what it really will mean in the long run, as responses are built to the defenses, is that it turns into an arms race where only a very few who spend most of their lives studying a few esoteric things will be able to mount the defense. At which point, as a tool for the removal of privacy from the masses, the deed is done.
