Stealing a candy bar is a bit different
than molesting children, raping women, murdering people, carjacking people, robbing banks, drug smuggling, or a number of other serious crimes. I've lost count of the number of child abuctions and rape/murders reported that have been perpetrated by pedophiles with "previous convictions". My way would rid the world of a few extra career criminals, but your way would ensure the status quo of catch and release, catch and release, ad infinitum.
