I'd have shot him in the leg or something non-lethal.

OTOH, the SOB probably would have sued and it would have ended up in the courts forever. However, the guy with the dog would have/should have (had he lived) been arrested for assault. He was in the wrong. But the death penalty? Sorry, probation is just too little IMO.
