You're either not paying attention or being obtuse.
A flag burning, however distateful, does not give an implied threat to your well-being.
A burning cross on your lawn gives an exact implied threat - "You're next ni....."
Even Scalia(?) mentioned if he were black he'd rather see a man on his lawn brandishing a gun, than a man brandishing a burning cross.
