From what I remember in law school, the 9th amendment has been given virtually no meaning by the Supremes. The law is what the Supreme Court says it is, as we've seen in recent years.
Anyway, this whole discussion is almost certainly moot - the Court will rule on equal protection issues and avoid privacy discussion.
