It seems to me that one problem with the Fed granting a right regarding sex is that the Fed now becomes involved in your bedroom- if some citizens are opposed to some sexual behavior of an individual, wouldn't the Feds be required to protect this individual's right.
And what is the legal distinction between your "home" and normally considered public areas- such as a restaurant or conference hall.
