the ICC

I think the ideal solution would be a trial in the Hague. If you look at the trial of Milosevich and his cronies it has gone quite well. In terms of history they have answered a lot of questions about what really happened. Of course Milosevich has made a lot of critical comments, some valid and some not.

In terms of knowing what actually happened the Hague has been very successful. Also the rule of law seems to have been meticulously followed and people have been tried and sentenced. Few seem to be getting off lightly.

I have a Bosnian friend whose job in the Bosnian Army was to film all the mass graves. The Serbs would come into each town and rape all the women and kill all the men, and he was part of a unit to video all the evidence. Needless to say the Bosnians are still very angry at the Serbs but the ICC trials have given them a lot of closure. While there is no death sentence that doesn't seem to bother them, the main thing is the trial is getting the answers and filling in all the gaps.

The opportunity is there to put all of Saddam's people on trial in the Hague and fill in all the gaps of history. A lot of this would look bad on Poppy Bush and Reagan, but it would clear up a lot of what really happened. If Saddam was "tried" and executed without knowing any more than snippets from interrogations then the information would never seem valid to people.

Another example was when Eichmann was captured and tried in Israel. It was done quite fairly and an enormous amount of information was gotten about the Thrid Reich, much of it surprising. Jews seemed to get a lot more closure out of this instead of a quick execution.

A similar event might have occured if Pinochet had gone on trial. Many other people from Hitler's government have also been tried and the historical record updated at the same time.
The desire for a lynching only lasts so long, to really do this properly would in the long run make all the victims feel better.

It may seem like execution would be more satisfying but my Bosnian friends get to think of Milosevich humiliated in this long trial, and they seem to get enjoyment out of that over a long period. Also the Nuremburg trials seemed to make people feel better and also told us a lot about what really happened.
