I agree. Anyone who lands in Gitmo should become a permanent guest of the US government unless it can be shown the person's capture was an error.
The $64,000 question: When are they going have tribunals that can hand down death sentences?
The legal basis for Gitmo was the eight Nazi spies who snuck into the US during World War 2 to engage in sabotage. After capture, the spies were tried by a military tribunal and 6 of them were promptly executed. It's not clear to me that the terrorists in Gitmo should be executed (they would become Islamic martyrs in the full meaning of the word). However the worst of them should have a dead sentenced passed on them and then left to rot in Gitmo for the rest of their lives.
