Smoking is almost criminalized, but smokers still have places to go. Cigarettes and other tobacco products are freely available.

Drinking one's self to death is only a crime if one makes a public spectacle of one's self (public drunkenness is a misdemeanor), or drives while intoxicated.

Take away one's right to food? We don't take away people's rights to consume known poisons. Why should we start with something we all need?

Addictions can't be cured by making them illegal. Making addiction illegal creates an entirely new set of criminals, not to mention a black market in the forbidden commodity. Addictions are health problems, and need to be treated as health problems to have a hope of remedy.
