So do a lot of other people

Historically, the law says that you can't defame the dead. There have been efforts underway to control the image of famous people after they've died and those efforts have been somewhat successful. "60 Minutes" had a segment about the King family several months ago and how they profit off of MLK's image. They justify this because when he was alive, MLK supposedly was so active in the civil rights movement that he did little to provide for his family after his death.

If memory serves, the laws were changed to allow surviving family members to have some degree of control over their famous relative's images. This happened after some artist released a picture showing John Wayne as a drag queen. Wayne's image has been used in some beer commericals in the past few years, but that was with the permission of his family.
